Abstract

The paper analyzes critically the legislative drafting of the forgery cases established in Paragraph 1 of Title XVII of Law No. 18,290. This study is based on the existence of a set of principles formulated by the specialized doctrine in the Science of Legislation. Among them, there are some that are considered more significantly violated by the criminal regulation under examination. In particular, based on three characteristics of the forgery regulation of the Traffic Law (casuism, use of referrals and regulation in a special decoded law), it is estimated that it could cause problems related to the requirements imposed by the principles of communicative capacity, legislative economy, systematicity and legal certainty.
