Findings from an empirical analysis on the problems of the confidentiality of the declaration of children in family justice

Abstract

In this study an examination is carried out on the way in which the confidential declaration is executed in family justice. It is argued that the way it is currently conceived in the law generates serious inconveniences. These problems are primarily related to the secrecy in which these hearings remain indefinitely, which in turn prevents the control of aspects that are important both for the rights of the children and adolescents who intervene in them, as well as the other parties involved in the proceedings. Based on this, some legal changes are suggested in light of the reforms that have been carried out in Italian legislation on this issue a few years ago.
