The price of statu quo. The standard of proof in administrative sanctions

Abstract

This paper defends the application of the standard “preponderance of the evidence” to the determination of facts on the field of administrative sanctions. For this purpouse, it analyzes the distribution of the risks of error offered by two types of standard and defends a specific distribution of them according with the aims of administrative law.
